Here at NewsFlicks.xyz (that’s “us,” “we,” or “our” place on the web), we genuinely respect the hard work and creativity that goes into making original content. We want everyone who uses our site – https://newsflicks.xyz/– to respect creative rights when reading about news, checking out tech tools, browsing our blog, or using our digital services.
This policy outlines our procedures for handling claims of copyright infringement under the guidelines established by the Digital Millennium Copyright Act (DMCA). It’s here to help copyright owners notify us if they believe their work is being misused on our site, and to inform our users about the next steps.
Think Someone’s Copied Your Work on Our Site? Here’s What to Do.
If you own the copyright to something (or you’re officially representing the owner) and you believe content on NewsFlicks.xyz is using your work without permission, please send us a message. We’ll need some specific info to look into it properly. According to the DMCA (that’s 17 U.S.C § 512(c)(3) if you’re curious), your message should include:
- Your Signature: A digital or physical signature from you or someone authorised to act for the copyright owner.
- The Original Work: Tell us about the copyrighted work you believe has been infringed. If it’s a few different pieces, a list with links to where we can see them would be great.
- The Content in Question: Please specify exactly where on our site the material you’re concerned about is located. The best way is to send us the specific URL(s).
- How to Reach You: Your name, address, phone number, and email address.
- Your Good Faith Belief: A statement saying you genuinely believe the use of the material isn’t authorised by the copyright owner, their agent, or the law. (Basically, you think it’s not okay.)
- Under Penalty of Perjury: A statement that all the information you’ve provided is accurate and that you are the copyright owner or are authorized to act on their behalf. This is a serious legal statement.
Sending all this info helps us process things smoothly. If something is missing, it may take us longer, or we may not be able to act on the notice.
What Happens When You Send Us a Takedown Notice?
Once we get a complete and valid DMCA notice:
- We’ll act quickly to take down the content or block access to it.
- We’ll notify the user who posted the content that it has been removed or disabled.
- If someone repeatedly posts content that infringes on copyright, we’ll take action, which may include terminating their access to our site (more information below).
Think Your Content Was Taken Down by Mistake? Here’s how to respond.
If you’re a user and your content was removed, but you believe it was a mistake or that you have the right to use it (perhaps you have permission or it’s fair use), you can send us a “counter-notice.” Here’s what that needs:
- Your Signature: A digital or physical signature.
- What Was Removed: Identify the material that was removed and where it used to be located on our site.
- Your Good Faith Belief (Again!): A statement, under penalty of perjury, that you genuinely believe the material was removed or disabled by mistake or because it was misidentified.
- Your Contact Info & Consent: Your name, address, phone number, and email. You’ll also need to state that you agree to the jurisdiction of the Federal District Court for where your address is located (or, if you’re outside the U.S., any judicial district where NewsFlicks.xyz might be found). This means you agree to accept legal documents from the person who sent the original complaint.
When we get a valid counter-notice, we’ll send a copy to the person who originally complained. We’ll let them know that we might put the content back up (or unblock it) in about 10 business days. If they don’t file a court action against you within that time, we may restore the content.
Our Policy on Repeat Infringers
We take copyright seriously. If a user repeatedly posts content that infringes on others’ copyrights, we will, in appropriate circumstances, terminate their access to NewsFlicks.xyz. We also reserve the right to limit access or close accounts of anyone who infringes intellectual property rights, even if it’s not a repeat offense.
Some Important Legal Stuff (Limitation of Liability)
This part is a bit more formal, but it’s essential. To the greatest extent permitted by law, NewsFlicks.xyz won’t be responsible for any damages resulting from a copyright claim. This includes all sorts of potential damages—direct, indirect, accidental, special, or punitive. We’re referring to losses such as lost profits, data loss, or other intangible damages. This applies even if we were aware of the possibility of such damages. We’re essentially stating that, while we’ll follow the DMCA process, we can’t be held liable for every possible outcome related to copyright issues on the platform.
